Here Are Some Of Our Terms And Conditions

User Agreement

1. By booking a service through Star Services, the user (client) is entering into an agreement with the provider (Star Services) from the date of start of the service.

2. Police Verification of Worker will be done by Client by their local Police Station.

3. Star Services will provide a replacement guarantee during the period of this agreement. The period of replacement will not exceed 7 days from the date of release of the last worker sent by Star Services. If Star Services fails to provide a replacement, Star Services will issue a credit note to the client, convertible to a refund (see refund policy at the end of this page)

4. Star Services will provide trained and professional workers as per industry standards. Star Services is not liable for any untoward incidents like theft, illegal activities, damages, etc. Star Services will assist in filing a police complaint if the situation requires such a step and Star Services will blacklist the worker for lifetime.

5. The worker deserve a respectful behavior. So it is the duty of the client to behave in an appropriate manner with the worker and not torture the worker mentally or physically in any way. The worker has the right to get fresh and timely meals, a clean and hygienic place to sleep, bathe and defecate etc. The worker has the right to get rest during work as per standards of Indian Labour Laws. It is always better to give rest for health and safety of worker

6. (A) Client cannot ask worker for those additional services for which worker is not booked for as per as per the scope of work in the online/written communication. If the worker is asked to do some additional work, it is up to the worker to agree to such work, client shall be liable to pay additional cost according to the work directly to worker. (B) For the avoidance of doubt, please note that the worker’s salary are payable to workers, and Star Services acts as a limited collection agent on behalf of such workers to collect and transfer amounts due to them. (C) Worker’s salary is inclusive of applicable taxes. however, Booking Fees and Subscription fees are not inclusive of applicable taxes. (D) Star Services reserves the right to reasonably amend the Worker’s salary, Booking fees and Subscription fees at any time at its sole discretion. A change in Booking fees and Subscription fees shall not impact any bookings that have been confirmed before the publication of the revised Booking fees or Subscription fees on the Website. (E) Client is full responsible to pay the salary to worker every month. Star Services is not responsible of worker’s salary.

7. Introductions are strictly confidential. If Star Services introduces a worker that the client then introduces to a third party, who hires the worker on either full-time or part-time basis, the new client agrees to pay Star Services the applicable charges and the former agreement with the original client stands cancelled.

8. The monthly charge of the worker will have to be paid in full for the number of days worked. The decided monthly charge cannot be reduced at any point of time due to any reason. A day would be counted as a working day even if the worker has worked for an hour on the specified day, even if it happens to be the day of termination of the worker’s services

9. Star Services has the right to ask the client for their ID and address proof to ensure the worker and company’s safety

10. General sickness, ongoing viral, flu etc. contracted during employment is under the scope of the client and Star Services will not be liable to arrange for additional tests or transportation for the same

11. In case the worker is absent because worker is unwell/family emergency, no replacement will be given if the worker promises to join back as soon worker is healthy/fit for work. In case the worker does not join back within 10 days, you can ask us for replacement.

12. If the worker asks for his/her salary in advance, it is entirely the Client’s decision to give him/her an advance salary. In case the worker leaves and you have paid excess salary to him/her, Star Services will not be responsible to retrieve/refund the same

13. Star Services will not be responsible if you choose to give any advance salary or goods to the worker

14. The client will check the bags, purse or any other thing that the worker is carrying before the worker enters the home and before the worker leaves the home. Whenever worker takes holiday please confirm to Star Services and check their bag at the time of living your place.

15. Replacement will be given to the client subject to the following issues faced by them, only in case the worker provided by Star Services:

(A) Worker is not skilled for the job

(B) Worker is unwilling to work

(C) Worker has behavioral issues or has medical conditions which cause an issue with the work or could be a concern for the client or their family members

Replacements will be provided at no additional charges. However, the transportation charges (outside and within the state of booking, for full-time/part-time workers) will be borne by the client for all replacements

Refund will be provided ONLY If

Star Services is not able to find a replacement even after 7 days have passed after the date of release of the last worker supplied by Star Services, for the same scope of work and hours as decided earlier, subject to pro-data subscription amount deductions and deductions of expenses at actuals, in the form of a credit note or bank transfer into original source of payment only. Please note, the salary (monthly charge) of a worker is SEPARATE from the subscription charge of Star Services. The two payments can NOT be linked or adjusted with each other. In case of a refund, the client first has to clear the salary component and only then can the credit note of the subscription fee be converted into a refund.

No replacement or refund would be provided if

(A) The worker at any point of time during the period of service is mistreated or abused, either mentally or physically or is made to work for more than 8 to 10 hours a day against their will

(B) The client decides to relocate outside of Delhi-NCR, or if the client tries to relocate the worker to any other accommodation (even within Delhi NCR) without informing Star Services

(C) The client decides to hire a replacement from any source other than Star Services

(D) The worker or Star Services is not at fault and it’s only the client’s wish to cancel the agreement

(E) The worker wants to discontinue the work (for any reason) and leave the client’s premises, of which the client has been informed by Star Services, and the client is holding him/her against their will

(F) There has been a change in the scope of work of the worker without intimation or approval of Star Services

(G) In case of replacement, the client cannot change the job description. If such a case happens, Star Services will try to find a relevant worker basis for the new booking made by the client. However, a refund of old booking will not be applicable in this case

(H) In case of replacement, the monthly charge of the replacement cannot be lower than the monthly charge decided previously

(I) All solicitations are subjected to Delhi Jurisdiction only

(J) The last right to terminate a contract without any compensation lies with Star Services. In case of cancellation from either side, a convenience cum cancellation fee of Rs. 1,000 only, will be deducted for training, quality, transportation and other expenses.
